Tax, fraud charges loom

THE ANC national appeals committee is to convene this week to decide on the future of ANC Youth League leaders including its president Julius Malema, who is fighting for his five-year suspension to be set aside.

The committee, which is led by Cyril Ramaphosa, is considering whether it should refer the matter back to the party's disciplinary committee to hear arguments in mitigation of the sentence.

Malema's troubles could worsen with reports on Friday suggesting that he could be charged with tax evasion.

Malema, together with his youth league colleagues - deputy president Ronald Lamola, secretary-general Sandiso Magaqa, his deputy Kenetswe Mosenogi, treasurer-general Pule Mabe and the league's spokesman Floyd Shivambu - have argued that the committee did not offer them an opportunity to lead evidence in mitigation of the sentence.

Malema and Shivambu have been suspended for five and three years respectively from the ANC. Should the appeal fail to set aside their sentences, they'll both have to vacate their positions in the youth league while on suspension. The other leaders were given suspended sentences.

Last week the committee sat for two days, where the league's legal team argued that the ANC national disciplinary committee did not give their clients the opportunity to argue in mitigation before handing down the sentences.

The youth league leaders were all found guilty of bringing the ANC into disrepute and disrespecting the officials of the ANC, who include President Jacob Zuma and his deputy Kgalema Motlanthe.

But Sunday World has learnt that the appeals committee is considering giving them the opportunity for mitigation.

The committee is understood to be considering whether to allow some or all charges for mitigation. This will see both the ANC and the league calling more witnesses during the mitigation.

After the two-day appeal hearing last week, Ramaphosa said the committee - which comprises heavyweights like Trevor Manuel, Jesse Duarte and Jeff Radebe - will release its findings soon.

  • Meanwhile the Southern Africa Report, an online publication, says that law enforcement agencies have gathered sufficient evidence to charge Malema with tax evasion and money laundering.

It says there is now a strong possibility of criminal charges relating to Malema's many business dealings linked to his Ratanang family trust.

"The next step is for the dossier of findings to be handed to the Hawks, where a decision will be made on whether to lay charges against Malema or not," the publication stated.

Really, Southern Africa Report of Karima Brown, well-known Malema hater. State institutions are being abused to pursue political objectives with a factionalist agenda, as seems to be the case. Pravin Gordhan of all people should not even talk to his former colleagues at SARS about pursuing Julius Malema because this will eventually catch up with him discrediting him big time.
